on the locked wheat thread where you stated 250 yards, I am under the impression that the law reads "in an area where bait is present" and that this basically signifies that the distance does not matter, especially if the hunter is trying to intercept the game in route to the bait

One of the issues we have had over the years is that "area" is not defined and was subject to interpretation by the hunter and officer. In order to bring some standardization of the interpretations by our officers, we came up with an internal enforcement procedure that says if the hunter is at least 250 yds from the bait and does not shoot into that 250 yard zone around the bait, that we will not consider it to be a baited situation. A 250 yd radius around the bait means that a 40-41 acre area is considered to be baited.

Our procedure does not apply to doves and waterfowl as there is federal case law that has dealt with the zone of influence on the migratory birds.
