Well, the wife hit a deer saturday, well actually,it ran into the side of the car.I was scouting for this weekend when she called, very upset. She said she was gonna call a neighbor to come put it out of its misery,I told her not to,to call the county sherrif.

I would think putting a deer out of its misery, while probably the right thing to do,would be illegal?Need a hunting liscense, not on your property, easy excuse for road hunting?

I would hope that none of our officers would even consider a citation for someone that actually puts a deer out of its misery.

However, with that being said, like you pointed out, it is technically illegal and could mask some real violations.

It gets back into the officer discretion area.

I had a 8 point run into me once.. it was on the side of the road bellowing.. trying to stand up.. I called the sheriff's dept and asked if I could shoot it.. it was obviously in pain.. no.. they said I had to wait until the GW came.. 30 minutes or so later he pulled up .. shot it and I helped him throw it in the ditch..

A good sharp knife could solve the problem.. Just use caution

What difference would that make?? The method used to dispatch a wounded animal was not the question.

why would you throw it in the ditch? It is legal to keep it and with the GW right there satisfies the reporting issue? If not wanting it at least take to a processor that donates to hunters for hungry

I will never leave a deer I hit if I can help it will throw it on roof and have kids hold it :) JK dont call social services

I didnt throw it in the ditch.. he did.. I just helped him.. I dont think hunters for the hungry was even thought of when this happened..it was years ago.. I was picking up material for my job, it was about 10 in the morning and hot as could be.. must have been late september.. I couldnt do anything with it at the time and I guess he couldnt either..

I imagine having a chief with common sense allows their officers to have good common sense. :)

I put a fawn down once that was hit by a car. making awful noises and no doubt broke in the back and no telling where else. Very sad sight and was very small, probably a month old or less.

A lot of the "issues" aren't there with a sharp knife. It is a great idea if it can be done safely.
Thanks for the reply scn,Ive finished a deer with a knife before,I wont do it again, got dangerous, and VERY messey.

My brother tried to put a buck down with a knife and ended up with the knife in his leg that could have been real bad as he was by himself. If I have a gun I will use it and if I have to it would be a trial by jury I don't think you could get a group of people to all be stupid and convict even if you could find one officer that would cite you and a prosecutor that would go through with the trial. Which in TN I just don't think that would happen. Now on the east coast I might think twice.

Unfortunately, sometimes legal and ethical don't mix well.
But, they always should !

there, fixed it for you

I will always put a wild animal out of its misery, if the judge fines me then so be it, I sleep better this way
Agree 110%. Drove up on a small buck that had been hit one time and was in the middle of the road thrashing around but appeared paralyzed a bit all the while several cars stopped just watching it. I stopped and my buddy and I pulled it out of the road and shot it with my pistol. No way I was going to leave it there suffering.

I passed a doe on the side of the road with its head up last year. I have a carry permit and had a pistol with me. I called the davidson county game warden and he told me to go ahead without really saying it. He said I could call Metro PD but they wouldnt want to kill it because they have to do so much paperwork if they fire their weapon and they would just call TWRA but most of the wildlife officers in the area were at a convention and wouldnt be able to come out.

Just to make sure I did call METRO PD dispatch and told them the conversation I had with the game warden. She told me she could not give me permission but to stand by and she would find out. 10 minutes later she called back and said the captain had given me permission to shoot the deer. I was told to leave it there and they would come pick it up....unfortunately it was never picked up and became buzzard food.

Did you sleep through Nov 6th? plenty of stupid people!
But i do agree they i would certainly put one down by any means available

Nov 6th TN showed we have 60% people with sense so I would take my odds that a jury of my peers (which I would cherry pick) would chose common sense. Remember only need one in criminal court.

Now like you and I agree Nov 6th proved there are states that have no common sense but I will be avoiding them. Matter of fact I will avoid stopping in IL for one. I will get gas just before and just after I leave that state.

Mule deer hit my work vehicle out west. Two broken legs in the middle of a dark country road. Two rounds in the chest and I dragged it off the road. Called Sheriff to report (I needed accident report for GSA).
Reported to my agency who opened an investigation/shooting review board (this was done back in DC). One board member actually voted for disciplinary action, stating I should have sought veterinary care for the deer! In the end, nothing happened, but this is still talked about.

I once saw a doe suffering by the road in davidson county a couple years ago. A cop car was sitting on the shoulder and the cop was filling out paperwork. I felt terrible for the deer.
