Got 2 more ladder stands now. Found them this mornin while huntin/scoutin a hillside on a farm I have permission to. Hadnt tried that side yet. Told the landowner and he said have at them. Got them cut down before storm moved in. We are guessin whoever it was, was comin in from behind the farm without being seen. Hopefully they didnt get the buck that left big rubs all over the hill side.
 
i hate trespassers. Trespassing is wrong but stealing is sin. it wasnt your land he was trespassing on.
 
If the stands were illegally placed on somebody's property, how is it theft to remove them under the landowner's direction? What is the proper procedure for removing them? The landowner should not have to involve the law unless he wants to press charges, right? Other than trespass, isn't this a civil issue?

Abandoned property, and gifted to him by the landowner. What's the problem?
 
good move, get on a public forum and admit to stealing, way worst than trespassing...

Don't they have to take them to remove them? Do they get to charge a storage fee?
 
So they can take them and throw them in the dump, but it's illegal for them to keep them? And wouldn't the landowner be the only one with any criminal liability since it was done at his directiona and it's his land?
 
If anything, the trespasser would have a claim of some sort of replevin, a civil action for return of property, and would have to pay damages for cost of removal, etc, in order to get his unlawfully trepassing property back.
 
What the heck is wrong with removing them and taking them?? Guess you should have taken them to the back of the property where they were entering and left them there with a note " here are your treestands that you placed on the private property to hunt, we won't be needing them and would like to return them to you. Thank You, sincerely property owner...
BS somebody hangs a stand on my property it's coming down and going in my shed!!
 
To set the record straight both stands are still on the farm. I cut them down but did not take them home with me. The landowner asked me to cut them down so I did. He wants to see if anyone claims them. but beings they were trespassing I doubt they will ask for them back.
 
There is a note pinned to the tree lettin them know its private property. same thing happened back in muzzleloader season. found one on edge of a field about 300 yds from the road. Took it down and laid next to tree. it stayed there for a week before disappearing. figured that was it. found 2 on the other side now.
 
Dumb question, but if u found a wallet, or bag of money or some other item that a tresspasser didn't want u to find, and u keep it, is that stealing?

I hope this isn't the definition of hijacking a post. If it is delete please.

This is exactly what is wrong with this country.
A man tresspasses and steals from you by putting up a stand and hunting deer without permission but who gets in trouble?

I don't care, if I find a trespasser's (i.e. poacher) stand on my place or a place I have sole permission to hunt I'm taking it in a heart beat and I will leave a note on the tree for he/she to call me if he/she wants his/her stand back. Guess what...I'm still waiting on the first call. Some of you who condemn this action probably don't understand some of the struggles private landowners go through.

there is differences between lost, stolen, abandoned, misplaced property, etc
In this case the trespasser still owns the treestands, but he is also liable for trespass damages, ie the cost of removing and storing, etc.

So if he came forward and offered to resolve the situation, he could get his stands back. In the meantime, who's to say what should be done with them?

At some point if doesn't come forward to the landowner and claim them, he will have abandoned them. As they say, possession is 9/10ths of the law :grin:
 
yep , i am taking them everytime. sue us.............the law wont/cant stop them even if they do the judge wont do anything to them . to quote a tndeer member "that is pure bovine scatology"
 
Everytime i find something on my land i take it down and write them a Note telling where they can come and pick them up. most of the time they know they was trespassing and never come and claim them.

But i have had a few come pick them up. and tell me they was sorry for putting them up on my land and it will never happen again. then i tell them if i find them up again on my land then they can't get them back because the game warden will have them.

Here Here that what i do every time i find one. and as of yet just a few has called to claim one.

That is the way I would do it as well. IMO, you are removing and storing. But, that is not how it was described in the first post.
