Illuminated Reticle?

I was looking at getting a new scope. The one I am looking at has an option for an illuminated reticle and I was wondering if it was legal for hunting in TN.

This is what the law says.

Firearms or archery equipment with any
device utilizing an artificial light capable
of locating wildlife.
�
Any electronic light amplifying night vi
-
sion scope or device while in possession
of a firearm or archery tackle between
sunset and sunrise.

I am going to be interested in what SCN has to say about this.
I am pretty sure he is going to say that a Red dot scope is ok as most states allow these since they really do not project a beam of light on the target like a laser or flashlight would do. . I really think it comes down to the spirit of the law rather than what the words really say.


But someone sure could make a effective argument that a battery powered red dot scope "could" be used to locate deer.

As long as you are not talking about a night vision scope, a lighted reticle is fine.
