hypothetical question

I dont know if you guys/gals remember, but this very incident happened to me last year. The saturday after Thanksgiving I was in stand, and a huge 10 point busted over the hill nose to ground, I put a 50 cal mzl slug in him, and get to tracking, and figure out i gut shot him.

After about 2 hours I continue tracking, and loose the blood trail at the creek, which is 40 yards from road, and across road is different land owner.

I cross creek and continue looking back and forth up n down creek bank, I had passed that buck bedded down 2-3 times, and never knew it!! He jumps up and heads across the road, and I coulda puked. I went to his bed and he sure nuff was bleeding out.

I call landowner that I have permission from, and tell him story, and he warns that the guy across the road is a pure butt plug!! So I drive over, knock on door, as Im waiting I notice a deer feeder in the yard... he comes to door with an evikl look on his face, and an elk printed on his sweatshirt! lol.

This could be good or bad.... It was bad, he was a total jerk. DEnied me permisssion and told me I had some nerve to even drive up the driveway and ask. I would guess that old fart went and got my buck. I still get a very sick feeling from this.

I later figured out my scope was busted on my mzlloder. everytime I would shoot, it would jump all over the paper, switched scopes, and fixed the problem. but I respected his wishes and didnt go after my deer.

In hindsight I wonder if I shoulda went on and did it. I was only doing the right thing, and meant no harm. Its easier to ask forgivness than permission, and I leardned the hard way.

Do you honest believe your desire for a deer over-rides private property rights?

Deer hunters are usually some of the greatest defenders of individual rights in this country. However, I'm a bit shocked by many of the responses posted on here suggesting hunters would ignore a land-owner's right to not be trespassed on. And let's be honest, it's YOUR responsibility as a hunter to produce rapidly killing shots. Every one of us has had a freak situation where a mortally wounded deer has run far farther than would seem biologically possible, but you know what? Them's the breaks.
 
Youre absoloutely right BSK. It wasnt as much my desire for the deer as it was owing it to the deer to do the right thing, and finish what I started. I didnt trespass, and the reason I didnt was because I respected his wishes , and the law. Whats right is right and whats wrong is wrong, and Ill say this.... Whats legal and whats illegal isnt always cut and dry the right or wrong way to do things. I didnt intend to violate his land in any way.... simply set foot upon it and get MY deer! Talk about making a swift kill..... when it doesnt happen I suppose you stop there and give up??? No sir. Finish the job and LEARN YOUR LESSONS. I learned a few that day

Yeah, and the part about Halle Berry in her Catwoman suit can make a fella forget all about deer season. :grin:

I agree that you should contact all surrounding land owners before season and see who is willing to let you track a deer onto there property, and thats what I have done since my mishap years ago.

However a deer does not know boundries and doesnt know which side of the property line to die on!! my family has owned property for years and has never given anyone trouble for tracking a deer onto our property as long as they asked.

But in my opinion if a landowner denies the right for a hunter to retrieve or track a wounded animal across a fence and he can prove he made the shot on the his/her property a GW should have the right to make a conscious effort to retrieve the animal I do understand property rights but landowners dont own the deer and many think they do
