I checked out the new property I have to hunt in Hickman Co. yesterday. It looks great and I really think it could be an awesome spot. The problem is I think it has lots of trespassing going on. There are trails coming out of a few back yards of people who live in the subdivision that it butts up too, and I found a tree stand that is questionable to whether it is on the property or not (right on the line, no fence or marker). Anyway the land owner lives a ways off and has told me I am the only one with permission and to keep others out if possible. Any recommendations for how to go about resolving the situation? I want to talk to the owners of the homes with the trails and let them know I will hunting but what else?

"Tennessee trespassing laws are explained in full in Tennessee Code 39-14-405. The law states that a person commits trespassing by entering or remaining on property without the proper consent. This offense is a Class C misdemeanor. Signage requirements are that the property owner must have signs that are visible at all major points of access or entry to the property and that they are reasonably likely to be seen by any person entering the property."

I am fairly positive it does step up to a class B misdemeanor if the trespasser is seen/caught damaging property or cutting/manipulating fences and gates. (not 100% on that so someone please correct me if wrong.)

Other than this I am unsure what you can do. However if these things are done, then the way I understand it is if some one is caught by TWRA or law enforcement then they handle it even without owner intervention. (not 100% on that either, just my understanding of it)

We are dealing with a similar situation as well. We will post and see from there.
 
I am not sure but i thought only the land owner could call LEO for trespassers.

Sounds like you're in or close to town, so it MAY be easier to get LEO there quicker than most places. Lot of guys think that since they've been hunting it, that means they have permission. I do think that with some signage and physical presence, you can keep it at a minimum.

I would recommend NOT going out of your way to inform neighboring landowners you will be hunting. If you run into them, so be it but some will not like it and may retaliate. Better to not be seen or heard. I would put up signs but not obtrusively. A few cameras might be advised and indicate property under surveillance.

Correct. It is my understanding this is true, unless a power of attorney on behalf of the landowner has been executed, which is not the case 99% of the time. Basically, leasees, tenants and hunting guests have no authority to prosecute. You can always PM "scn" on here to get the official answer.
 
Posting your land is the first best defense. It gives your landowner more legal standing if a case goes to court. Getting the word out is good. We had a lease that was crawling with poachers and road hunters. Working with your landowner and aggressively prosecuting offenders is the only way to solve that issue. I warn once then I;m calling the Sheriff or TWRA depending on the violation.
