Good for them. What I fail to understand is what Mark Kelly(Gabrielle Gifford's husband) thinks he's proving by purchasing the rifle in the 1st place. He says it was too easy for him to buy it?? As far as I know he's never commited a crime that would or should prevent him from buying a gun. What does he expect to happen when a law abiding citizen such as himself tries to buy a rifle??

I would of refused the sale also, once I found out what it was being purchased for. Let someone who wants it buy it. I bet it didn't set around on the shelf for long.

If he filled out the paperwork saying it was for him and then came out to the media and said he was going to give it away, there is thier out. He lied on the paperwork, which I'm pretty sure is a crime, but I could be wrong on that.

It's illegal for any FFL holder to knowingly sell to a person making a straw purchase.

What I'd like to know, is why isn't this guy being charged with a federal gun crime? He already bragged that he was making a straw purchase - where's the ATF???

Or maybe, he was tying to 'bait' the gun shop into breaking the law because he was a high profile buyer, but got called on it....

IT's kinda sorta a Straw Purchase but not really. A true straw purchase is where customer A submits to the background check because he knows that he can pass, while customer B is the real person buying the gun but does not think he can pass the background check. This guy didn't really do that because he's intending to turn the gun over to either the police or the press rather than an individual.

However, any grief that can be caused for Mr. Kelly is A-OK with me.
