We'll lets see. As Judge Learned Hand said, there is no moral or even patriotic duty to maximize the amount of ones taxes. One could say that what BK and the other US corporations that have done an inversion are just following the American way. It figures that statist democrats would be the ones calling for boycotts as they rarely have seen a tax they didn't like, as long as they, like the hypocrit and crony capitalist extraordinaire "tax me more" Warren Buffett can pay to find a way out of it. Rather than see why it is the US corporate tax system that is driving this (and the related fact that corporate boards of directors have a fiduciary duty to maximize earnings for shareholders), Dems call for a boycott. Don't fall for it.

This is being driven by three factors. First, with globalization, US companies increasingly find their business growing overseas while it is stagnant or mature at best in the US. Second, the US corporate tax still applies to those companies' worldwide income, unlike the "territorial" systems of other countries. And, to avoid the taxation of that foreign source income if they set up a foreign subsidiary, the dividends are then taxed by the US. Whether earned via a foreign branch or as dividend income via a foreign subsidiary, the foreign source earnings are subject to a tax rate of 35% or even higher. But they get a foreign tax credit. The credit is of increasingly less value to US companies when foreign corporate tax rates are a half to even two thirds less than the US rate. As a result, US companies are sitting on vast sums of cash parked overseas. Third, the company gets access to that cash and instantly becomes subject to another country's territorial tax system for it's growing overseas market while it's mature US market remains the only piece of the company's business subject to the high US tax rates and that business is declining in relation to that overseas for all of the reasons discussed on this forum ad infinitum day in and day out.

That is why I ate at BK for the first time in probably 15 years today.
