ok fixen to buy my first big track of land well big to me 25acre and someone a (family member) has it leased till 2018. so when i buy the land does the hunter still have there lease or is the lease terminated due to it changing hands? never bought land before with a lease in place. i ask the owner of the property how the lease was writen and he said he dont remember he would have to find the contract. anybody ever been in this situation?

It's their lease if the payment has been made until 2018 unless there is written in it anything about the property changing hands voids the lease.

The closing should be handled by a title attorney. Either you or the current owner (or a realtor if one is involved) will select the title company. Once you know who will handle the closing, give them a call to discuss the status of the lease. The title company should not charge you for the information since they will be performing a title search on the property as part of their service to handle the closing.

I would have never thought of that being an issue. Thanks for the heads up.

Hope it works out right for you. Would this be a deal breaker? Would you receive the lease $$$. Surely it was not all pre-paid.

Does a hunting lease run with the land? If so, wouldn't it have to be recorded on the deed? If it's not, isn't it just a contract between the previous owner and the lessee? How could they be in position to enforce lease terms with a new owner if he wasn't a party to the contract?

I agree. If there's nothing in writting saying "if land is sold the lease goes with it" then sorry bout their luck. If it is and they can continue to hunt it 4 more years then I'd rethink buying it. Especially if you were buying it mainly for hunting.. Just my opinion.. If I'm buying land I sure don't want nobody else on it!!

I'm buying the land to put me another house on like I need another done have 2 but I'm needing a bigger house to many kids. But the land will be hunted by me and the kids also but I'm like some if I buy land I don't want every tom dick and hairy all over it and me and the kids worry about being shot the lease was all paid up front I do no that guy was needing money so that was fast cash. Besides if they still get to hunt it they want see much with a dozer and tractor running all the time

Yes, he's probably a slob hunter, this is dangerous for you and your family, kick him off the property ASAP even if you don't end up buying it..... it's a safety issue, we all know how deer hunters are.
