Well as most of you know, mom and dad have been semi retired for the past few yrs and have been fishing most of the time. Mom took a side job to get extra money so they could go fish. Back in 1997 they bought a brand new bass boat to the specs they wanted. I remember going EVERYWHERE looking at boats back when they were looking at them. That boat was their baby...garage kept, waxed, and washed after every trip.

Friday evening they went to Watts Bar and got into the stripe and white bass breaking. They caught a bunch on topwater and spoons. On the way back home something bad happened. On the road they live on...less than 400 yards from their driveway. They encounter a dude on the wrong side of the road in a green BMW. Dad saw him coming toward them and got over as far as he could...but the guy still hit them. It tore the whole side out of the boat trailer and damaged the boat pretty bad on the bottom. The back end of the boat came off the trailer and hit the ground. Broke the transom saver into...and the motor hit the ground itself. The motor has quite a bit of damage to it where all the weight of the boat went down on it. It ripped the trailer hitch out from under the truck, and bent the frame of the truck.

They weren't hurt but the boat and trailer are destroyed. The BMW was in bad shape as well. The guy driving it had insurance but was doped out of his mind. He didn't even know he had wrecked. He was still sitting in the car not moving...dad thought he was dead because he had hit hard and not much was left of the front end of the car. The police estimated him going 60+ MPH when he hit. He skid over 100 yards after impact. Dad is heartbroken. This was their only hobby. The boat was in SUPER condition but it was a 1997 model. The insurance company is not going to pay much for it because it was a 97 model and 16 yrs old....especially not enough to get another boat. The pics show the trailer damage but most of the damage to the boat is underneath. It broke the wheel off the trailer axle and bent the axle itself too. Must have been a heck of a hit.

That really sucks, sorry to hear about that. Can't imagine my tin boat getting hit, much less someone's very well cared for boat like that. Hope the insurance pays for as much as possible. And glad they were not hurt.

No it wasn't a DUI. He was just on something...maybe like a zanex or something like that...where he just wasn't "all there" so to speak. They got the official police reports back yesterday and have been playing tag with the insurance companies, etc. The guy had told his insurance company that he wasn't at fault...but the police report and all that showed otherwise, so that's been the hold up thus far. We've found a few prospect boats on Craigslist that we are gonna inquire about as soon as they get $ and such.

Dad just got back from the body shops about his truck and it done quite a bit of damage to it as well. They are sad to see the boat go but glad the guy at least had insurance.

I knew a guy that got a DUI for using a prescription med and having a reaction to it... The guy should still be charged with DUI.

Don't settle for less than you want. It was the other guys fault. Hold out and tell the other insurance company to find another boat that is in as good of shape to replace it or pay what $$$$$$$ you think it's worth. Insurance company's want to settle quick! Don't play there game, make them play yours. You pay insurance for reason, not to come out in the hole if someone else totals your boat.

me too, I'd be more than pissed if someone hit my boat, or even my truck for that matter. They both are like extensions of my body to me.

Here's the story as it was related to me: the guy driving the car that hit dad's boat...he didn't call the county police. He called his dad first. Now this guy is in his 50s, and his dad in his 70s. The police got there about the same time the guy's dad did.

This whole time, the guy in the car is saying he wasn't at fault...despite the trajectory evidence showing otherwise. The police weren't having any part of that...and pointed out to the guy where he had crossed the line and hit, and where he ended up. There were several police officers that came to the call...and the higher ranking one was over there talking to the guy's dad...who is a preacher in the county. Well...evidently ole daddy had gotten his boy out of trouble before, and thought he was going to have this handled his way. Because as he was talking, he said aloud "I'm going to get this turned around right now" in reference to the police saying that his boy was at fault for the wreck. That didn't go well for him on the part of who was at fault...but the ranking officer that responded, didn't want to give the boy a drug test or anything like that. He was the one who knew the preacher man...that's what he called him was "preacher". The other officers wanted to give him some kind of test...they were all certain he was on something but they went off to talk among themselves and they didn't give him any kind of test. So in that aspect, I think ole "preacher dad" had something to do with that part of it.

At any rate...that's where that stands. The official report said it all; it showed he was 14 inches over the yellow center line when he made contact with the boat/trailer...would have liked to seen more done but there was a reason he called ole dad up to get him on the scene...and I guess it was to keep him from going to jail.

Tell the you want to be made "whole". Find comparable boats for sale, add in the cost of the time dealing with this, and damaged tackle, depth finders, etc. and come up with a number that will make your parents whole. In other words, have them on the water in the same condition they were before the accident. Don't settle for anything less.

If need be, hire a lawyer. I bet daddy preacher will pay up quick when his son is about to go to court, to "keep him or of trouble". A good attorney will probably call for the preachers son to be drug tested, and daddy preacher couldn't ever let that happen!

I'd file a civil suit and get everything I deserve from that bastard. Your Dad and Mom should get a good lawyer and claim their golden years have been ruined by the reckless and negligent acts or Mr. Silver Spoon and they are in constant mental distress and suffering depression because they can't enjoy their time together on the water. Take it to a jury, you'll win in McMinn county!

^^^^This^^^^^

I would also be talking to the "ranking officer's" supervisor and if necessary have his arse for not drug testing an impaired driver!
