In a meeting at work today we were told by our HR manager that even with the new carry law, If we have a gun locked up properly in our vehicle we can still be terminated. Our facility is not guarded or fenced, I have no plans to test them but several people said it was "B.S." I am not familiar with the way the law is exactly written I was just curious too know if they were right about it still being grounds for termination if you were caught somehow?

As I understand it, they can still ban guns on the property, but they cannot search your vehicle for one.

39-17-1313. (This law becomes effective 7/1/13.)
(a) Notwithstanding §§ 39-17-1309, 39-17-1311, or § 39-17-1359, unless expressly prohibited by federal

law, the holder of a valid handgun carry permit recognized in Tennessee may transport and store a firearm or firearm ammunition in the permit holder’s privately-owned motor vehicle, as defined in § 55-1-103, while on or utilizing any public or private parking area if:
(1) The permit holder’s vehicle is parked in a location where it is permitted to be; and
(2) The firearm or ammunition being transported or stored in the vehicle:
(A) Is kept from ordinary observation if the permit holder is in the motor vehicle; or
( B ) Is kept from ordinary observation and locked within the trunk, glove box, or interior of the
person’s privately owned motor vehicle or a container securely affixed to such vehicle if the
permit holder is not in the vehicle.
( b ) No business entity, public or private employer, or the owner, manager, or legal possessor of the property shall be held liable in any civil action for damages, injuries or death resulting from or arising out of another’s actions involving a firearm or ammunition transported or stored in accordance with subsection (a) unless the business entity, public or private employer, or the owner, manager, or legal possessor of the property commits an offense involving the use of the stored firearm or ammunition or intentionally solicits or procures the conduct resulting in the damage, injury or death. Nor shall a business entity, public or private employer, or the owner, manager, or legal possessor of the property be responsible for the theft of a firearm or ammunition stored "by the holder of a valid handgun carry permit in the permit holder's privately-owned motor vehicle".
(c) For purposes of this section:
(1) “Parking area” means any property provided by a business entity, public or private employer, or the
owner, manager, or legal possessor of the property for the purpose of permitting its invitees,
customers, clients or employees to park privately-owned motor vehicles; and
(2) “Parking area” does not include the grounds or property of a owner-occupied, single-family detached
residence, or a tenant-occupied single-family detached residence.
Note: My understanding of the law is that a valid permit/license holder can store a firearm in a public or private parking area and not be breaking any laws. The law is specific that the vehicle must be the “permit holder’s privately-owned motor vehicle.”The law also does not cover workplaces (Including Schools/Colleges/Universities) that have rules against Employees/Students having firearms on their property or in their vehicles. If your Employer/School has such a rule this law will not protect you from being Fired/Expelled but only from breaking a state law. See Attorney General Opinion on the Parking Lot Storage Law in the AG/Court Case Section below.

Good Info, but I didn't see where the vehicle could be legally searched or not by the employer. It just read that the weapon had to be out of sight.

You might very well be terminated, IF they found out you had it in your vehicle. But, I would venture to say, that the new HC law may be used for a lawsuit against your former company, if you so chose, for possible illegal search and seizure maybe?

most companies require a new employee to sign an agreement for terms of employment. a right to search is included in many of these.

I didn't have to, thank goodness, or I would most likely be working somewhere else. I'm very fortunate to be working for a company that is very conservative and constitutionally minded.

The company I worked for the past 15 years before retirement, had a no gun rule period on any of their property. I traveled all over and in some areas that wasn't to safe, they knew I had mine told them I had it never said a word. I was lucky I didn't get canned.
