i dont think it is crazy at all

you can not be a resident of 2 states at the same time as far as drivers license go when u get a DE lic you tn license is turned in and is no longer valid thus your TN hand gun permit is not valid cause you are no longer a resident of this state

common sense if you ask me

now do i think he should be charged with a felony

absolutely not

You can have residences in two states, but you can't be a legal resident of both states. You have to check the legal definitions for residents and make a decision.

We run into it all the time with people that are a legal resident of another state with that states DL, etc., but want a resident license because they own a home here. They don't meet our legal definition of resident, and therefore don't qualify for the resident license.

I hope it works out for him, but it looks like he has some problems if they move forward with prosecution.

It's something to remember if you dabble back and forth between two states.

I was not saying that it was crazy that he could not have DL or carry permit in both states but that it would come to the point of prosecution and loss of job etc. I understand the letter of the law and yes he was in violation although not intentionally. I think a little discretion would be in order.

Agreed. I hope that they allow some discretion.
