Can somebody please tell me the regulations on gill nets along the hiwaissee refuge? Next one I get into im gona start taking days off from fishing just to go net cutting. Im tired of these being put out in the most fished part of the river.

Contact Region III for the areas open for commercial fishing around the Refuge with gill nets. My guess is that if it is an open area you would be liable to any damage to a commercial fisherman's net.

Back in the early-mid 90's, I was stringing gill nets all over Norris Reservoir - from the dam up both rivers as far as I could go.

All with a valid collection permit from TWRA via TTU.

Be careful about cutting any nets, it is more likely a valid reason they are there, than not.

As a side note, Andy Collins pulled beside me around Island F one day. Another grad student and I had 8-10 tubs full of fish to be worked up and around 15-20 nets we had just pulled. Andy's eyes were gleaming as he thought he was about to make a heck of a bust. I gave him a copy of my permit and a call to his dispatch prevented our arrest, but he still double-checked fire extinguishers, life jackets, etc. He was very professional and cordial during his visit with us and afterwards. I hope he is still doing well.

I know they have to make a living to but its so frustrating everytime u turn around either your line or your prop is getting tangled up in them.

I found some hoop nets last year that were full of dead soft shell turtles probaly 8 or 10. There was a tag on it that said research. So I cut my line and put it back

I finally found the Title 39 law I was looking for:

39-14-206. Taking fish caught by another.

(a) It is unlawful for any person to take fish out of the box, net, basket or off the hook of another person, or to raise any box, net, basket, or trot-line, without the consent of the owner of the device, unless the fish is taken by an officer to be used as evidence in the prosecution of a violation of the game and fish laws.

(b) Any violation of this section is a Class C misdemeanor.

HISTORY: Acts 1989, ch. 591, § 1.

That law makes it a Class C misdemeanor to mess with any commercial fishing gear. If you get a lure/prop hung, I would think that you would have a defense against this statute if you untangle your gear. But, there is no doubt it is against the law to mess with commercial fishing gear otherwise.

Thanks. I appreciate the advice but if I get into another net in the most dense fished place on the whole river (at average 15 boats trolling in this cove) their going home one less net. They got the whole river to put em out in why put em out where they know everybody is? The refuge opened march 1st and I was down there at daylight. Eased into the cove and got my prop stuck in the net. So whats the penalty for fishing the refuge off the main channels before the season?

I guess if it opened on March 1, it opened at 12:01am. Unless you know it was set before March 1, there wouldn't be much of a case.
