I understand that in TN a high fence can be erected and the deer that are trapped inside can be hunted. A neighboring landowner has done just this. He also has placed metal "gates" at various locations throughout the high fence. The gates can be opened periodically to allow wildlife to enter and exit and then closed again. Is the practice of "trapping" wildlife repeatedly in this manner legal? If so, can the landowner legally charge a fee for "hunters" to enter the enclosure and shoot these deer? Also, if the opening of gates is legal, how about the legality of a device that would allow deer to enter the enclosure but not exit the enclosure? A one-way door, if you will. Thanks, HMH

There are no regulations against putting up fencing. Any animals trapped inside are still property of the state and not the landowner.

Gates are left open all the time, so there would be no violation there. However, I suspect any one way gates would be construed as an effort to trap wildlife and would not be legal.

The deer in such a fenced area can only be hunted during the statewide deer season and under statewide bag limits and manners and means. All applicable licenses would be required. Charging someone to hunt under those conditions would be no different than someone charging a hunt fee on an unfenced property.

But it's illegal to "put" deer in the high fence right? For example, you cannot buy a deer from a breeder and put it in a high fence in TN right (regardless if you hunt it or not)?

Reason why I ask is because if you can, I am about to start a new business in my back yard. At the NWTF show some guy was charging $15k to shoot a deer in a high fence that was only like 100 acres in size, this was of course in another state.

It is illegal to deal in live whitetail deer in TN. They cannot be bought and possessed in TN, regardless of the type of enclosure.
