I hope everyone has a will. I can't imagine not having one and more than likely creating problems for your family. They are not just for those of us in the fourth quarter, either.
Yesterday, I had mine updated with a simple addendum. Many of the special bequests I made no longer were valid as the people I had laft things to were dead. So, in a one page document, I updated everything making it much simpler. I worte it myself and just has it notarized and attached to my will.
if you donot have a will, no matter your age, I encourage you to do so. It is cheap, I wrote my own, and simplifies things a great deal. This is especially true if you have property and real estate. I also suggest getting a power of attorney.

AMEN!
Even a simple will is better than no will at all. But an outdated will can sometimes be as bad as no will.
I also suggest you find someone to be your "Will accountability partner". Every year you and your accountability partner pick a date where you meet with your WAP and you both make sure the other has updated their will base don any life changes.

I need to do that. I'm only 40, but I guess I should get started on it.

It will still have to go thru probate. Any land or real estate or vehicles..mainly valuable things..go ahead and put them in the names of the ones you want to have them. I just finished dealing with all of this from Dad's passing in Sept of 2011. Please if you don't do anything else..put these things in your kids names now. My attorney fees were expensive.

I'm not trying to even begin to act like I am an expert on any of this. Just hopefully I can save some expenses and heartache from others.

I've had one since I was 23 years old, I can't believe people who don't have one!

Writing your own will is nice only if everybody is all on the same page. Yes all you have to do is have it witnessed and notarized. Those are the cheapest and easiest to do.
But they are also the easiest ones to beat in court.
People change at the drop of a hat when they see an opening where they can take others to court over a homemade will and win it all for themselves. Who's going to stop them, your dead and gone. Don't take my word for it ask any lawyer, they sure see enough of this very thing every week.
If business, houses, land, and/or large amounts of money is at stake then get to your lawyer and have him draw it all up as well as all the updates. Your family will thank you long after you are gone.
Once they all see it's 100% legal and there is no way to contest it your family will NOT GO TO WAR WITH EACH OTHER over it and the family will stay together like YOU WANTED IN THE FIRST PLACE.
