Didn't want to post this on the scout thread but i got a hypothetical. All you people that were in fraternities in college(i wasn't) What if they would have told you that you had to open membership to anyone that wanted to be in it , regardless if you didn't want them in. What about the All Black or All White fraternities.

Private groups and exclude anyone they want as long they take no public funds -
At least that is my understanding....

There is a wide range of things private organizations can do that would/do offend someone. It's a matter of how much bad publicity one can take. I wonder what happens when the first Scout is abused. Whose to blame then? I say the BSA would be sued to no end. All that for political correctness.

As I mentioned on the Scout thread, historically all-black fraternities routinely admit non-black members. However, I'm not aware of a single social fraternity that places restrictions on their membership at the national level. Local chapters certainly abide by their own "in house" criteria for membership, especially at large state schools, but from my experience at a small university, making friends in the chapter is the only criteria.

Correct....but the national charter organizations do not have policies stating membership restrictions. If SAE fraternity refused to admit gays, you'd have folks all up in arms at their national headquarters, as well.
I believe KA fraternity had numerous issues in the past with excluding black members.

A private club, such as a social club, country club, etc can discriminate as long as it does not accept public funding.
The Supreme Court ruled in Hastings vs the Christian Legal Society Chapter of Hastings College that it was illegal to exclude Gay membership in the society. Since Hastings College had a Non-Descrimination "All Comers" Policy in place. It also stipulates that all entities that accept public monies must adhere to the "all comers" clauses of the non discrimination act.

All white fraternities do not exist to my knowledge. I don;t believe all black ones do, though no one would have the audacity to speak up if they did exist.

Kappa Alpha Psi Fraternity Inc is a historically African American fraternity. I have never heard of a member of it of any other race for that matter.
