Just the way my brain works, can't explain it, I just go with it. \:\)

I was wondering the other day if it was legal to kill a chipmunk.
I didn't see a season for them in the guide so I assume it would be illegal to kill one.
Just sitting there hunting the other day and thought it would be neat to have one mounted.

Legal or not?

Those are the loudest little rodents I have ever heard. Sounds like a dang herd of elephants coming through the woods.

You ever heard them "bark"? Sounds just like a turkey cluck to me.

Thank you sir.
Kinda figured that when I didn't see a season listed but wanted to check.

Not like I could kill one anyway, I have only seen like 4 in my whole life anyway. \:D

That would be a different situation than "hunting" on. Under TCA 70-4-115, a landowner may destroy wild animals causing him/her damage.

The statute has restrictions on big game animals (requires a permit), and federally protected animals would requyire a permit from the USFWS.

You would be well within the statute to deal with your chipmunks.

Oh ok thank you. It happens every spring. I'm headed to the river. Hit the fresh air vent and it sounds like my dash is about to fall apart. And everytime I pull the fan out its full. I thought it was squirrels but I never see any. Then one day I found them nested in my boat and watched then go in my yota...one way or another they are gone in a few weeks

I have a friend that is on squirrel 51 after paying over $700 to replace wiring and a chewed up gas tank. If he sees them around his truck, they better be scooting.

Your situation is what 70-4-115 was designed for.

My neighbor took pride in shooting chipmunks with his pellet rifle. He killed nearly 100 every year. He was retired and had time to keep count.

Anyways- he moved and 2 years later there was no increase in C/M population. I would have figured the neighborhood would be overrun with them after he left...

Wouldn't that damage rule apply here? I wouldn't think you would have to let them live in your attic. That makes them the same as a rat in my book. I don't want any critters scratching around in the ceiling above me.

yeah chipmunks and flying squirrels have both caused damage, I just like to limit what I say on a forum, if you know what I mean. I wouldn't just go out and "hunt" the rodents outside my yard if there is no hunting season for them. But if they invade the house, they are in a lot of danger. I have various weapons...

And, if they are in your house, causing damage, they are yours to kill (with the exception of the federally protected ones).

The landowner damage statute requires a depredation permit for big game such as deer, so you would need to have your local officer on speed dial.
