As far as the water swattin' goes, I've done it, and will probably do it again, but you have more target if you let'em get up or shoot'em as they are dropping in.
IMO the reason for that law is to keep guys from running up in coves on birds or up on rafts of birds and shooting them. Not sure thats the reason, but either way, if I have a cripple on the water, I will exhaust every effort to put it in the boat and if that includes shooting it while the motor is running, well then so be it.

With some of the old boat motors we had when I was younger, we were about half afraid to turn it off once we got it started LOL. Don't have a duck in the hunt, but that right there is funny.... guess because I can relate. Trust me, the last situation you want to experience is being in a boat with motor problems.... it's around or below freezing, the water is whitecapping, and the wind is blowing you away from the boatramp!!! Cold rain, sleet, and/or snow only make it worse...
and the only thing worse than that is when the motor won't run and lightning is suddenly hitting the water every 15 seconds, been there and done that one...

Ive shot em off the water and id say i will again. I prefer to shoot em when they are cupped and commited.
I hear this argument from about everybody who has ever duck hunted
