I just picked the meat up. It was not frozen. It was in a walk in cooler set at 38 degrees. I ask the processor if he thought it was ok and he said he had no idea, just have to try it." He was very frustrated and said he has countless people who won't show up to pick up their deer.

wow, never picked up deer meat from a processor that was not frozen solid!

If his temp. is below 36, it should be fine. Above 36, I wouold be a tad leery. Also, you owe for it either way. YEP

I'd say its fine.
Someones going to have to explain to me the difference between hanging a deer to age the meat when temps are in the 40's and what happened here. Isn't it the same thing? Lots of processors hang deer in the cooler for several days before processing.

Oh, he11...the meat is good...if it's a legit processor then the meat is great...curious why you are concerned? Was it a backwoods guy that does it in his backyard?
