During the tornadoes in march I have had some roofing damage, Ive filed a claim with the insurance, it has been 2 months since the claim was filed, Ive still not recieved a call or seen an adjuster. Ive spoke with the insurance agent every 2 weeks, he asures me they are just behind. I called today and was told that they had to fire some adjusters for not filing claims. I know 2 people that has recieved checks and repaired their roofs, that live within a mile of me. After all that here is my question....How long should I wait for the insurance, should I speak to a lawyer? or just pay out of pocket and hope for the best? Were talking $7,000 in damage, Im not wanting this to turn into 10-15 grand in damged sheet rock and joists cause of leaks. Ive got the roof tarped, but dont know how long it will last.

I would think that if you raised enough cane with your insurance company, they would get someone out there. Time not to be nice.

Well if they fired some people.... it sucks having to keep calling, maybe your stuff got lost in the paperwork being shuffled around.... keep calling and be nice for so long, then put it to them.... many folks with damages out there, it may be an honest oversite on the ins. co. part.

Getting an attorney at this point won't do much. Just keep calling and document every phone call and when you called. Would think adjusters are pretty thin still with the storms and damage all over the place. Might be time to start climbing the ladder though with the Insurance company.

Work your way up the ladder..call document who you talk to and if no satisfaction ask who there boss is then talk to them.

oh and talk to your agent..they should be helping you get this resolved, they get a commision every year on your money.

Hiring a private adjuster really helped us when our house was trashed in the Nashville floods last year - this is a negotiator who fights the insurance company for you, and on commission so he's motivated to get as much as he can. Chadd at First Call in Nashville did a great job for us.

We have home owners insurance through Liberty Mutual. Last week I called a reported a claim due to a lot of tabs being blown off during the storms this year. Today i had an independent adjuster come and look at the damage. He said due to the # of tabs missing and the condition of the remaining shingle, he is going to recommend a new roof. He will be filing the claim to the office and said I should be receiving a check in approx 2 weeks. We'll see. I think you're getting a run around from your ins co.

Have to be patient with all the storms and damages. However, 3 months is too much patience.
Start calling everyone daily until this is resolved and document everything.
Afterwards and all is done, may want to find another insurance company.

You have been more then patient. The magic words that will get the insurance companies attention is that you attorney stated the case is not being handled in “Good Faith”. Put it in writing and state that date you filed your claim and that you have not seen or heard from any insurance adjustor representing their company. You should also state by their failure to act you have suffered consequential damages due to the leaking of the roof. If you are getting mold in the residence let them know they are creating a health hazard. When you submit your claim make sure you get reimburse for any incidental items such as the tarp and any other item you had to purchase to prevent addition damage. Unfortunately some insurance carriers play the game of holding out on paying until they absolutely have to. Most people do not know their rights and the insurance carrier with make money on their ignorance. I practiced law for many years and have dealt with many sleazy insurance companies. Document everything in writing. Hopefully your carrier is not Direct General out of Nashville.

Most likely, you're responsible for the mitigation of loss, in other words, to tarp the roof if needed. If it needs to be retarped, do it again. Don't give them a reason to deny any part of your claim. They will pay you for your time and trouble spent to keep their claim amount down. Talk to the adjuster about that. All of the insurance companies are swamped in East Tennessee and the farther you are from a major population center, the longer it may take for them to get to you. From what I know, the Good Faith mentioned is for them low balling their pricing or denying a claim. They haven't even seen yours yet. I'd call your agent every day and let him know you're gonna be calling every day until you get some answers. Ask him if it would be within your rights to slow walk your premiums like they're slow walking your claim.

Ive been with farm bureau for 26 years, never had an issue. Only had 1 claim and that was storm damage in 2000 when a twister tore my front porch roof off. Its like someone was saying earlier custermer service is getting pretty bad these days a phone call from an agent or whoever sure would ease alot of tension or worries in cases like this.

I understand where you're coming from. I tell all of my customers or potential customers that the next time their insurance company calls to ask if they've been damaged, it'll be the first time. Farm Bureau isn't the first insurance company I would call if I was to change carriers. Matter of fact, I wouldn't call them at all. They have low premiums, but it's like most other things in that you get what you pay for.
