Sorry BigJ, but I have to disagree, which is ok. The "thug" deserved the first shot, but not the next 5. The threat had been obviously eliminated, and the pharmacist was in control of the situation. I think manslaughter may have been more inline than first degree murder, but I wasn't on the jury and didn't hear the arguments, nor the judge's declarations. There is another thread on here somewhere that shows the video of the shooting for those that may not have seen it.

He murdered the thug. The first shot neutralized the threat then the next 5 were murder. I do think that the heat of the moment clouded his brain and he should have been convicted on a lesser charge. He still should be doing time, just no more than 25yrs.

Yeah. The next 5 were probably not needed. More of a waste of ammo.
First degree murder though? All depends on where the bullet hit the boy. If it grazed his head than he needed to be followed up on. If it went thru his head than yeah the other 5 were bad form.
Either way the guy should not have been sent to prison considering what he may have considered imminent threat.
I would be interested to see where that first bullet hit the kid.
Fact remains the same. The thugs caused this shootout. Not the worker. They put him into the position he was in and how he reacted in that situation could be considered temporary insanity due to the pressure and situation he was placed into by the thugs.
Hey it works for the crooks. Maybe they should have used it in this case.

I don't see how he can see the thug as an imminent threat when he walked past the guy with his back turned to get another gun.
But I mean I agree with you on the sentence being ridiculous.

I dunno Big J, the thug was down, no threat and un-armed. Covering until police arrived was the correct thing to do I think. The extra 5 would have been fine by me, if they followed the first one immediately. The way it went down was a bad shoot in my opinion, if it was LEO, guy protecting his family and friends, or in this case preventing a forcible felony and protecting people in the store. The Jury saw it as a bad shoot and I think I agree on this one.

I do think the sentence is harsh, he certainly wouldnt get that here, but the last 5 bullets had to be unjustified. He should have fired those immediately as the thief hit the floor.

I agree, the bullet to the head was deserved, the other 5 after he was down and on the floor were not. From the video clip it was almost like he shot him, realized what happened after a moment and exacted a little extra.... I dont know I was not there, but the witnesses were and the guy got convicted. I would think the witnesses would have coraberated the story if he was coming back to a threat and not shooting someone already down. Its sad really.
