The retired cop who taught our CC class in '99 used just about that same scenario to teach us what NOT to do. He basically said if a guy is trying to rob or hurt you with a weapon and you shoot him, you're fine legally. But if you walk up to him while he's lying on the ground and shoot him again, you're going to prison. You're only allowed to use deadly force to protect yourself and others and stop the threat, and escape the danger if possible, not murder an incapacitated person on the ground.
I hate it for the pharmacist, and I'm sure I would have been tempted to do the same thing in his shoes. But according to the class I took to carry concealed, he was wrong.

Yeah. I agree the pharmacist should not go to prison. The last 5 shots I would consider as bad form. That's all.
They say if you shoot make sure you kill them or you will pay them forever. I am sure the head shot would have probably killed the kid. If it grazed him though he could have still been a threat.
If it knocked the kid incapacitated. Well like I said. You can kill him. Its just kinda bad form.

That guy is a cold blooded murder.
Sorry but that's the law and I agree with it. Once the threat is gone or is down and not a threat anymore you yourself must stop. This man did not but shot the guy that was down several times, THAT is NOT self defense. The split second he shot the guy that was down from the first shot he went from being the victim to the aggressor in a murder and that's what the jury got him on. He also moved from victim to aggressor when he went after the other guy.
All the different states laws allow ue to defend ourselves and others BUT that is to defend ourselves and ESCAPE. The second he went after the other guy he wasn't defendinmg himself any more but was the attacker. When he came back and got another gun then went to the other guy, that was down and wounded, and shot him to death then he became a murder.

I think so too...In the heat of the action the store owner seemed to forget that the camera was taping everything...He went by the the guy twiced before he decided to empty his gun into him....
If your gonna do it,...you'd better do it right...

Watch the video. He clearly walks pass the downed kid and ever TURNS HIS BACK TO HIM as he goes to get another gun.
When he turned his back on him that shows he KNEW the kid was no threat any more.
That was cold blooded murder.
