I'm not so sure the guy didn't want something to happen. Granted I didn't really read it all to make sure I got everything straight. He had a tape recorder and had it recording while it was going on. Maybe not but makes me wonder.

Even if it is legal its foolish to do so in a public place. Right or wrong it will eventually make someone nervous and they will call the cops. When they do they aren’t going to report “someone is legally carrying a weapon and not causing any trouble” More than likely they will report something like “A man with a gun is about to kill someone” …and the cops will respond accordingly.
I see a culture of folks raising their kids to view cops as the enemy...even fear/hate them. They ain't perfect and sure a few may be scumbags. But you can find scumbags in any profession. Law Enforcement Officials have my deepest respect, they deal with pissed off people all day long and don’t get paid nearly enough.

You know, I realize it's legal. And I realize there's a Constitutional right to have firearms. But, I know how people are. And I'm too busy to want to mess with the results of carrying a weapon openly when I have so many methods of keeping it easily hidden. I've got places to go and things to do. No time or interest in making a statement like that.
I've been asked for my permit by an officer one time and that was because my shirt blew behind the holster and it was visible for about 2 seconds. He asked, I showed it to him, he grinned, thanked me and told me to have a nice day. Pretty painless.

Illadvised only becasue of LEO's that do not know the law.... and have a chip on their shoulder. Dont think that many on here would agree with this statement, but its your right to speak what you think.

I agree with everyone who says that when you open carry, you are going to draw attention to yourself. My problem is how the police handled it in the situation above. There is no reason the individual should have been in custody for 45 minutes. There is no reason an individual should have to be pronned out on the ground while the officer checks for a HCP. Now we have a law abiding citizen who has a criminal record, has to pay court costs and pay an attorney. Something is wrong with that scenario.
I work with LEO types everyday and I have to say the ones around here are top notch and a pleasure to work with. But just like any profession, a few bad ones give the rest a bad name.

Many LEOs do not know the laws. I was a passenger recently in a vehicle that was pulled over for speeding. The driver elected not to inform the officer that he was carrying (you are not required to in TN, though I generally do inform as a courtesy).
When the officer returned with the citation, the officer asked if the driver was carrying and when he responded in the affirmative, the officer stated that he could write the driver a ticket for "failure to inform" and this ticket would result in the loss of the Carry Permit. This was a completely false statement and the officer was either clearly confused about the law or making things up on the spot. Of course, the driver did not argue, we both thought it was interesting, though.

With all the statements being said. Lets look at it from the LEO's point of view....Seeng a person carry a pistol, confronting that person, Stating an order to that person that was ignored. Even if the dude was telling him that he has a permit, what criminals dont lie? Would a criminal say something like that just to try and get the drop on a cop? Come on....All though it was a little over the top I am willing to say the guy was looking for a confrontation, as for the cops point of view Im willing to bet he comes across more crooks with guns than good guys. Its all he faces every day people that break the law. Its just stupid to open carry and try to buck up to the police when your trying to make a point. He should have went out of his way to do what the cops was asking or yelling at him to do. Im shocked he didnt get tazed or a night stick across the shins for his trouble. There is proving your point and then there is being an idiot trying to prove your point

How many criminals intent of committing a crime are going to advertise by wearing a weapon openly? The person in question was obeying the law by carrying like he did. The Officer was the one in the wrong. How many times have we heard "ignorance of the law is no excuse"?
The LE did not know the law, and that is a problem.
What would Patric Henry have done in that situation? His philosophy of "Is life so dear or peace so sweet as to be purchased at the price of chains and slavery? Forbid it, Almighty God! I know not what course others may take, but as for me, give me liberty, or give me death!" seems very akin to the reaction on the part of the carrier.
