Red oak for sure, thats definitely not in the White oak family.

It is either a black oak or a scarlet oak. Hard to tell which without seeing bark and leaves. Both black and scarlet oaks are in the red oak family. It is definitely not in the white oak family.
Either species is certainly eaten by deer, but whether it is preferred just depends on what choices are available at the time. The only way to tell is by looking carefully underneath the tree for fresh sign. If the sign is there, it is preferred. If it isn't, they are feeding on something else - possibly another tree of the same species.
