BigGameGuy, Not trying to be smart, but what would you do? I guess more importantly, is what is the correct and legal thing to do? I really don't know, but I know what I would do.
I guess (or assume) there are some common sence gray areas in some regulations.

You shoot a buck at last light and it breaks him down but the deer stumbles out of your sight . You can hear the deer russeling in the leaves and then quitens down so you give him the customary time limit and go to the deer . ok,..as I sometimes do(conicly OCD) I read the point of the original thread again....I guess first of all.... what is the customary time? ...  second of all...If a deer is broke down...its down,....why wait at all...  .....
The reason I used the phrase customary time is because every one of us are different human beings so what is your customary time in this situation ? Mine would be to use patience and wait before going after animal about 30 min. Have you ever jumped a deer you have wounded at dark thirty ? Not a good feeling to me , been there done that ! Any way I will not hesitate to shoot a downed animal I just wanted to get some different opinions and maybe the legal side of this sceniro .Well it's not like you are hunting after sunset (poaching) it's that you are doing what is humane . We that have hand gun permits would not hesitate to shoot an animal that has been hit by a vehical to be humane , right so I think we owe this to the animal we (most) as hunters have great respect for ! Hopefully this will not happen to me (or you)again but if it does .. I'M SHOOTIN'

not really sure, but as long as the shot that brought the animal down was taken during legal shooting light, then the follow-up shot time should not matter...IMO.

I got what you mean now...sometimes when folks use the term customary time they use it in a general umbrella statement. Often begining hunters, and even some old timers, seem to feel like there an official pre determined x-amount of time in every situation...I agree with you, everybody is differant as is every situation when a deer goes down...sometimes I will wait and there are times I will not...kind of depends on what I read out of the deers actions.... When I hear and use the term broke down, in my mind, the deer has 100% of its physical and mental faciltys from the rib cage forward but can't really get back up because the back end just won't cooperate....a VERY dangerous animals, buck or doe (even squirrels)...but it ain't going anywhere unless it drags itself farther down a hill(and almost ALWAYS farther from the vehicle!!) ....those will get another shot and be done with it...
As far as the legality issue, to me its kind of like driveing a severly injured person to a hospital...I am not gonna be wreckless by any means, but I probably won't be maintaining the legal speed limit either...

Shoot him. Who cares about the law when its the right thing to do. Chances of a warden being within 10 miles is slim to none anyway lol Thats what I'd do....I don't think a GW could cite you, unless he actually saw you do it anyway.
Uh yeah, go ask that GW that ticketed me 10 years ago in Arkansas for skillet shooting the mallard drake I knocked down 30 minutes before because I couldn't catch him and didn't want it to suffer with a busted wing. I fired one shot and the group near us unloaded on a flight around the same time but guess who they waited on to come out of the woods? That particular duck cost me $180 CASH before I could leave. That's what I got for being honest......
