Here the last I am going to say on this subject and what I did in to a sorry no good piece of trash's treestand. My property is unbelievably posted that Stevie Wonder would know when he crossed the property line. It is ringed by a 2 strand 3 foot tall high tension wire fence, there is a posted and patrolled sign every 15 feet for the entire boundary as well and a road cut just inside the fence that is maintained as clean dirt so I can see boot prints.
So the piece of white trash, knew he was over the line, and knew I was serious. Yet, he still chose to push the envelope and teach his child how to be a slob hunter. Just what we need is more slob hunters.
I would do the same thing tomorrow if it came to it, and yes I carry a pistol at all times, when not at work. But it is in my truck during business. I would also, not even hesitate to put someone in their grave if they even remotely threatened me on property that I paid for, that I pay property taxes on each year, and that I pay to maintain annually. If that makes me a bad guy, then so be it, but I am not some cowering sissy who will back down one inch from some no good poacher, and certainly not when they are doing kids a disservice.
My name and number is clearly marked on my posted signs, and if the guy had the gumption to pick up the phone I would have gladly let him take his son during juvi days. However, he chose to poach, and it cost him a stand and his pride.
Maybe those who wish to cast stones at me, don't own any land, have never dealt with trash poachers, or are afraid to stand up to another man when necessary. Whatever the case may be, that is the way it is when it comes to my property. I don't work all week long to pay for something, so that others can sneak in and steal from me.

Who going to hunt your ground when you are in jail? Be hard for a lawyer to defend you with all you have said on here,If you truly think it is justified to take a human life over trespassing. If the guy with the stand had the same attitude as you, then one of ya'll would probably be dead now. Not judging you, just hoping you might re think some of your positions.

A simple trespass issue would not end with me killing someone, but him threatening my life with a weapon would. That would also not be illegal, that is self defense.
Also, I forgot to add, if he or anyone wished to challenge me on the destruction of the treestand. Go ahead sue me....

Setterman,from what I am reading in your posts ,you are extremly paranoid,and confrontational,and hotheaded.That does not make a good combonation when dealing with a situation such as you had. If I had been at the scene YOU would have gone to jail,plus pay for the damaged tree stand, and the tresspassers would have gotten a ticket or a warning.. Think about that Sir..

Of course any crooked cop could take a person to jail for any reason at all, only for them to be released later.
You need to read your handbook and the laws of this state, armed trespassing is a serious offense in TN. It can result it in 11/29 if convicted. Destroying the treestand, would be simple destruction of property, however in court since that property was on my property it would more then likely get thrown out.
Now if things escalated and I pulled a gun on the guy, I could be held for reckless endangerment, however, seeing how they were armed, and on my property, once again I win.
See this all goes back to it being on MYproperty, not just randomly out in the country. I certainly hope you aren't a LEO. Go read the case from 4 or 5 years ago where a genetlemen shot 2 guys dead for riding ATV's on his property. He was released after 1 hour, and the courts found him not guilty on all counts in both civil and criminal trials. Why? It was on his property, no different then breaking something some owns that is found in your home.

I dont pretend to be any body,I am not a crooked cop,and you seriously need to get a grip.Destruction of private property IS a jailable offense,Whether its a 50.00 treestand,or a 1000.00 treestand.. The guy who killed the people on the atvs that were tresspassing is now serving life in prison,and almost got the death penalty. I have no interest in discussing this thing that happened to you, just trying to give you some real life facts to save you a lot of possable jail time if you injured these people ,not to count the lawsuitsyou would face.I am not taking up for any tresspassers,but thats all I will say on this..
You need to research the ATV cases, there have been two in the last couple of years that I know of, one in AL. Where the guy did get hammered, because it was premeditated. The other was here, and he was found innocent on all counts, and both civil/criminal cases were ruled in his favor.
On the destruction of private property, you are so wrong it is hilarious. Once property is placed in a permanent manner on another property it becomes the property of the landowner. Especially when it is done under illegal terms. I have friends in high places that know a heck of a lot more about the laws in this state then myself, and obviously you.
As I said earlier, I am through with this topic, and would do the exact same thing tomorrow if pushed to do so.
