if i was to privately sell a handgun that is registered in my name to another- in state, what is my legal obligation. i know there are folks on here that know . it's been soo long, i don't know what laws have changed. at least if you are at a gunshow you could get a background check done. thanks, tim

If you are in Tennessee they give you the money, you give them the gun. "Gun sold" . If it was me I would at least get an ID and record for your own records who you sold it to.Other states have different laws, Michigan has some other requirements on handguns.

If you want to get it out of your name then both of you go to an FFL holder and transer it to the buyer just as if you shipped it to another state and the buyer had to pay the transer fee.
If you don't care about getting it out of your name then sell it to them and you're done.

yep, my gunsmith mailed me a simple form stating...I_________sell ____________ S.N.__________to:__________ address _________drivers lic# __________ received___________signature & date of recipiant______________...i just didn't know if any of that brady law applied to us here.can't be tooo careful

I don't know why with rifles or shotguns face to face is ok with me,but handguns I want it out of my name and I want a copy of a drivers lic. that shows how old they are and that they can legally own a handgun. I go to my pawn shop here and have him do the paperwork,Cost me $10 for him to do and I have no worrie's. This stems from in my younger years I sold a .357 to a guy and it was used in a shooting,I got a very special visit from two goverment workers in suits.

Although you have no specific legal obligation to do so, better to have a paper trail. Include the serial number, make and model, caliber and the name of the buyer/seller. Additionaly make sure the buyer ascertains that he is 21 and can legally purchase a handgun. Keep the original.
This should protect you in the event that the handgun in question is used in some criminal violation.

good advise. we got some fine folks here on tndeer, some that never post only lurk or watch the classifieds. then when the man was a MARINE, well i ain't met a bad marine yet
