I don't really see on the other thread where the people that thought foodplots and baiting were the same were pro-baiting.

Tailcams don't have guns and nobody is standing there holding the trailcam, spotlighters possibly can have guns making it harder on CO's to enforce no night shooting...My opinion is that there should be no spotlighting.

Thats just the thing...baiting, by definition, is not allowed now or anytime in TN.....by definition if it is not be hunted over it is not considered baiting, its feeding...I wish they would just do away with feeding all wildlife altogeather....

That's a tough call whistlinwingman. I realize spotlighting being illegal makes poaching enforcement easier, and most of us want to see greater enforcement of poaching laws. If someone is willing to obviously risk prosecution for shining a light, odds are high they are willing to break more laws by shooting.

On the other hand, we also have a legal system based on the idea of innocense until proven guilt. Assuming someone who shines a light to look at deer is guilty of wanting to poach those deer runs contrary to that principle.

Again, very tough call.

Biologically, neither practice--spotlighting or trail-cameras--does any harm to deer.

Very interesting, I've never thought of it that way before. It just would be 2 hard to regulate spotlighting

I may get blasted for this, but if I want to go ride around on MY property at night and shine a light around the fields I will. This law is asinine.

I don't particularly agree with shooting deer at night using a spotlight, but for it to be illegal to shine a light around YOUR own private property is border line communist.

It is unlawful for any person, or one or more of a group of persons together, to willfully throw or cast the rays of a spotlight, headlight, or other artificial light in an apparent attempt or intent to locate deer by the use of such light.

That would be hard to prove in a court of law, IMO.

Yep. Dont go telling me I cant shine a light around a place I bought and paid for. If you shoot a deer, thats a whole nother thing but just for shining is way over the line and thats how most judges will see it as well.

I have shined a light looking for cows, horses, and while coon hunting. If I see a deer I will check it out. Don't see the harm in it.
