I have a quick question if someone could help me out. I have a pontoon boat, and its registered in my name. If I go on the water and drink a few beers and designate my friend to be the sober driver who has not drank a drop is that okay?

If you are not operating the boat and had a sober driver, you could not be charged with boating under the influence.

However, it would not protect you from any public intoxication charges. And, as the registered owner, you would still be the person responsible for the registration, certificate of number, and all of the safety equipment. And, if your driver had an accident, I suspect your name would be on any lawsuit filed.

As you can probably infer, after all I have seen over the years, I am not a fan of any booze on the water. My personal preference, which is no longer any type of TWRA opinion, would be to see TN adopt the standards from some other states totally banning booze from any public waterways.
