This type of nonsense, journalism is a big part of many American's ignorance with regards to our, laws, customs, and governmental procedures.

Does it discriminate against women. Maybe, depends on you opinion only.

The next part though is laughable, because too many think that federal law trumps state laws. I know that is how it ends up working far too often, but the 10th amendment (actual constitutional amendment) says the states are sovereign and can make their own laws inside their borders. The SCOTUS does not make laws and their decision in a case, from the 1960s (I think) does not create law, and it sure as heck doesn't create a constitutional amendment. The only violation of the constitution happening in these types of cases, is a violation of the 10th amendment.
